/01agreement

the agreement..

by signing up for the waitlist, accepting an api key, or sending a single request, you agree to these terms with Chisick Enterprises (operating “scrub”). if you're agreeing on behalf of a company, you confirm you have the authority to do so. if you don't agree, don't use the service.

/02the product

what scrub is..

an api that classifies text (and eventually images) for moderation. it returns a decision, a tier, a list of categories, and an optional rationale. that's the product. it is not:

  • a replacement for human review on edge cases — escalate them to a person.
  • a legal compliance tool. it does not certify your platform meets dsa, kosa, ncmec, or anything else.
  • a guarantee of any specific accuracy figure. published numbers are observed in our internal evals.
/03keys

your account & keys..

you keep your api keys secret. if a key leaks, rotate it from the dashboard. you're responsible for usage on any of your active keys until they're revoked. one human, one account; share access through team seats, not shared logins.

/04acceptable use

acceptable use..

moderation is a sensitive domain. you agree not to use scrub to:

  • build surveillance tooling targeting individuals based on protected characteristics.
  • process content from minors that you are not legally authorized to process.
  • circumvent the api's rate limits, reverse-engineer the models, or attempt to extract training data through prompts.
  • resell raw api responses as your own moderation product without a written agreement.
  • send malware, phishing payloads, or csam — even for "testing." we report csam to ncmec.

we reserve the right to suspend any account that violates this section, with or without notice depending on severity.

/05beta

beta status..

during the private beta, the service is provided as-is and may break, change, or be paused without warning. specifically:

  • no sla. uptime targets are aspirational, not contractual, until ga.
  • no price commitment. beta access is free or discounted; final pricing is announced at ga and applies to invoices issued after that date.
  • no feature commitment. anything on the roadmap can move, change, or be cut.
/06billing

billing (post-ga)..

once we're out of beta and you've moved to a paid plan: invoices are issued monthly in usd, payment due net-30. overage above your plan tier is metered per-request and added to the next invoice. you can cancel any time and we won't charge you again — but we don't refund partial months. taxes are on you.

/07your content

your content, .

everything you send to the api is and remains your data. you grant us a narrow license to process it for the sole purpose of returning a moderation decision and operating the service. we don't train on it, we don't share it, we don't keep it longer than §04 of the privacy policy describes.

our content, .

the scrub api, models, dashboard, docs, and brand are ours. you don't get a license to copy them, redistribute them, or use the marks except to say “powered by scrub” with a link back. that's it.

/09warranties

warranties & what we don't promise..

we'll use commercially reasonable efforts to keep scrub running, accurate, and secure. but: no software is perfect, machine-learning systems make mistakes, and ours will too. we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

/10liability

limitation of liability..

to the maximum extent permitted by law, our total liability for any claim arising from your use of scrub is capped at the greater of (a) what you paid us in the 12 months before the claim or (b) usd $100. we are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

/11indemnity

indemnification..

you agree to defend and indemnify us against third-party claims arising from your use of scrub in violation of these terms — particularly your content, your acceptable-use violations, or your misrepresentations to your end users.

/12termination

termination..

either side can terminate at any time. on termination, your keys stop working, your account data is purged within 30 days (per the privacy policy), and any unpaid invoices remain due. sections that should reasonably survive termination — IP, liability caps, indemnity — survive.

/13jurisdiction

governing law & disputes..

these terms are governed by the laws of the state of california, without regard to conflict-of-law rules. disputes are resolved by binding arbitration in orange county, ca, except either party may seek injunctive relief in court for IP misuse. you waive class-action rights to the extent permitted.

/14updates

changes to these terms..

we'll update this page when something material changes and email anyone with an account. continued use after a material change means you accept the new version. if you don't, stop using the service before it takes effect.
